Welcome our esteemed user!

Please read ("HomeOven”) terms and conditions ("Terms”) before using our services.

By accessing or using HomeOven, you indicate that you have read, understood, and agree to be bound by the Terms and to the collection and use of your information as set out in the HomeOven privacy policy ("Privacy Statement”) set out below, to the extent permitted by the applicable law.

Services Used

We provide links to home businesses ("Partners”) and allow you to order items for delivery ("Services”).

Once you have placed an order, your items would be delivered to you by the Kitchen ("Delivery”) or, if enabled, may be picked up at the kitchen’s address ("Pickup”).

We are not responsible for testing or assessing, and we do not warrant the offerings nor the products of, any of these businesses or individuals or the content of their applications. We do not interfere in any way in the production of any food produced, we only offer the ability to search for and find local Partners that deliver or make food available to their addresses and enable ordering food through this application.

We do not in any way independently verify the credentials, representations or products of Partners, the ingredients or the quality of any products, or that a Partners in compliance with applicable laws, regulations, and standards pertaining to food preparation, sale and safety.

We do not in any way guaranty the quality of any food or that any food complies with applicable laws and does not guarantee matching the menu displayed on the site of what is actually provided.

Some Partners may use nuts or other allergens in the preparation of certain items. Please contact the Partner directly prior to ordering if you have an allergy. We cannot guarantee that any of the items sold by the restaurants are free of allergens.

In addition, a Partner may represent that food preparation is in accordance with special standards such as "organic”, "macrobiotic", "gluten-free", or "lactose-free", we do not investigate or verify such representations.

HomeOven does not assume any responsibility or liability for the actions, product, and content of any Partner. We may share your information related to those transactions with the relevant Partner. Please ensure you thoroughly review their privacy policies and any other conditions applicable.

We allow Partners to list and sell their products on HomeOven. While HomeOven helps facilitate transactions that are carried out on HomeOven platform, HomeOven is not the buyer nor the seller of the relevant items.

HomeOven provides a platform for Partners and buyers to buy and sell their products respectively. Accordingly in such cases, the contract formed at the completion of a sale only formed between the buyer and seller. HomeOven is not a party to this contract nor assumes any responsibility arising out of or in connection with it nor is it the seller's agent. The Partner is solely responsible for the sale of the products and for dealing with any buyer claims or any other issue arising out of or in connection with the contract between the buyer and seller.

When you place an order through HomeOven, it needs to be accepted by the local Partners before it is confirmed. We inform you via the app if your order has been accepted (the "Confirmation Notice”).

The contract for the supply of any item you have ordered comes into existence when the Confirmation Notice is displayed. You are responsible for paying for all items ordered using your account, and for related delivery charges, and for complying with these Terms, even if you have ordered the item for someone else. Some Partners operate a minimum order value policy. All Items are subject to availability.

Accounts Policy

To use HomeOven Services, you may need to create an account, and you may be required to be logged into the account and have a valid payment method associated with the created account.

When you create an account with us you represent and affirm that the information you provide is accurate, complete, and current. Inaccurate, incomplete, or obsolete information may result in termination or suspension of your account.

We reserve the right to refuse service, suspension, terminate accounts, remove, or edit content if you are in breach of applicable laws, these Terms or any other applicable terms and conditions, guidelines or policies.

Delivery

HomeOven works on a scheduled delivery ("Scheduled Delivery”) basis. When you place an order, you must be available to accept delivery for your requested delivery date or pickup at the partner’s location, if allowed by the partner. Once an order is placed, you must be available to accept delivery.

Unfortunately, despite our best efforts there are factors such as traffic and weather conditions that may affect delivering your Item on time.

We will attempt delivery at the address on your account. It is your responsibility to ensure you have included an accurate pin to ensure your Items reach you. If you need to change the delivery location after you have placed your order, we may be able to change to the address to an alternative one that is registered with your account if you let us know before the driver has been dispatched, and the new address is within the same zone as the address you originally ordered your Item to.

If we cannot change the delivery address, you have the option to cancel the order, but if food preparation has started you will be charged the full price for the Item, and if the driver has been dispatched you will also be charged for delivery.

You will still be charged for the Item and for delivery in the event of a failed delivery if you have caused such failure for any reason. Reasons you might cause a delivery to fail include (but are not limited to):

  • you do not answer the door.
  • did not pick up the phone when the driver contacted you using the contact information you have provided us; and/or
  • you picked up the phone but then failed to provide access within a reasonable amount of time, and the driver is unable to find a safe location to leave the food.

Cancellation

You may cancel an order without charge at any time before the Partner has started preparing the food ("Confirmed Order”). You can cancel an order before it becomes a Confirmed Order by swiping on the order and selecting "cancel”. If you cancel any order after it becomes a Confirmed Order, you will be charged the full price for the Items, and if the driver has been dispatched you will also be charged for delivery.

We and the Partner may notify you that an order has been cancelled at any time. You will not be charged for any orders cancelled by us or the Partner, and we will reimburse you for any payment already made using the same method you used to pay for your order, or we may apply credit to your account to reflect the amount instead.

Payment

Payment for all Items and deliveries can be made by credit or debit card. Once your order has been confirmed your credit or debit card will be authorized and the total amount marked for payment (in respect of all payments made by credit or debit cards). Payment is made directly to us.

Electronic Communication

We will communicate with you electronically in a variety of ways, such as by e-mail, text, in-app push notices or by posting e-mail messages or communications on the application or other mediums HomeOven may use.

License

Subject to your compliance with these Terms and your payment of any applicable fees, HomeOven or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license ("License”) to access and make personal and non-commercial use of the HomeOven Services. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use any content on our site in any way except for your own personal use.

HomeOven is the owner of or the licensee of all intellectual property rights on our Services, and in the material published therein. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

The License does not include any resale or commercial use of any HomeOven Service or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any HomeOven Service or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

All rights not expressly granted to you in these Terms are reserved and retained by HomeOven or its licensors, suppliers, publishers, rights holders, or other content providers. No HomeOven Service, nor any part of any HomeOven Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. You may not frame or use framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page layout, or form) of HomeOven without our express written consent. You may not use any meta tags or any other "hidden text" utilizing HomeOven's names or trademarks without our express written consent.

You may not misuse the HomeOven Services. You may use the HomeOven Services only as permitted by the applicable law. The licenses granted by HomeOven terminate if you do not comply with these Terms.

Liability Limitation

Access to our Service is permitted on a temporary basis, and we reserve the right to withdraw or amend access to our Service without notice. Your access to HomeOven Services may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. HomeOven will not be held liable for any disruptions that may be caused due to this.

HomeOven will not be liable nor held responsible for any delay or failure to comply with our obligations under these conditions if such delay or failure arises from any cause which is beyond our reasonable control.

Terms of Use for our Application

The terms under this section set out the terms of use on which you may make use of our Services as a guest or a registered user. Please read these terms of use carefully before using our Services. By accessing or using our Services, you accept the terms of use and agree to abide by them. If you do not agree to these terms of use, please do not use our Services.

Acceptable Use

You may use our Service only for lawful purposes. You may not use our Services in any way that breaches any applicable local, national, or international law or regulation or to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards outlined below. You agree not to access without authority, interfere with, damage, or disrupt any part of our Services or any network or equipment used in the provision of our Services.

Suspension and Termination

Failure to comply with the above acceptable use provision constitutes a material breach of the Terms of Use, and may result in our taking all or any of the following actions:

  • immediate, temporary, or permanent withdrawal of your right to use our Service.
  • issuing of a warning to you.
  • legal action including proceedings for reimbursement of all costs on an (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

The responses described in this clause are not limited, and we may take any other action we reasonably deem appropriate.

Change of Services

We aim to update our Services regularly and may change the content at any time. This may result in the temporary suspension of our Services or closing them indefinitely. Any of the material on our Services may be out of date at any given time, and we are under no obligation to update such material.

Third Party Links

Any links on our Services to other sites and resources provided by third parties are provided for your information only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Update of Terms

We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make and are binding on all users.

No Waiver

Failure of HomeOven to act on the breach of any of the Terms shall not amount to a waiver of such breach or acceptance or variation by HomeOven. Furthermore, no waiver by HomeOven of any breach of the Terms, express or implied, shall serve as a waiver of another breach of the same nature and HomeOven will still be entitled to use the applicable rights and remedies.

Applicable Law and Jurisdiction

These Terms and the Privacy Statement are governed by and construed in accordance with the laws of the United Arab Emirates. If any dispute, claim, difference, or controversy arising out of, in relation to or in connection thereof, such dispute shall be referred to the exclusive jurisdiction of the Dubai Courts.

Privacy Policy

Personal Contact Information

 

Home Oven may collect the following information from users of our site: first name, last name, street address, area and city, phone and contact numbers, e-mail address, GPS location (mobile site) (collectively, "Personally Identifiable Information").

In addition, Home Oven may collect information regarding Home Oven account holders' past Home Oven orders, favorite providers, customer service inquiries, service/kitchens reviews and certain social networking preferences (e.g. pages you "Like" or "Recommend").

Home Oven also may use web analytic software to track and analyze traffic on the site in connection with Home Oven advertising and promotion of Home Oven services. Home Oven may publish these statistics or share them with third parties without including Personally Identifiable Information.

Non-Personally Identifiable Information is aggregated information, demographic information and any other information that does not reveal your specific identity. We and our third party service providers may collect Non-Personally Identifiable Information from you.

Use of your information

 

Home Oven uses Personally Identifiable Information to create users' Home Oven accounts, to communicate with users about Home Oven services, to offer users additional services, promotions and special offers and to charge for purchases made through Home Oven.

Home Oven uses cookies to remember users on the site and to enhance users' experience on the site.

User generated content posted through the site such as service/kitchen reviews and certain social networking preferences (e.g. pages you "Like" or "Recommend") may be viewed by the general public. Accordingly, Home Oven cannot ensure the privacy of any Personally Identifiable Information included in such user generated content.

Because Non-Personally Identifiable Information does not personally identify you, we may use such information for any purpose. In addition, we reserve the right to share such Non-Personally Identifiable Information, which does not personally identify you, with our affiliates and with other third parties, for any purpose. In some instances, we may combine Non-Personally Identifiable Information with Personally Identifiable Information (such as combining your name with your geographical location). If we do combine any Non-Personally Identifiable Information with Personally Identifiable Information, the combined information will be treated by us as Personally Identifiable Information hereunder as long as it is so combined.

Your Email and Mobile Telephone Number

 

To register for an account, we require you to supply us with your email address and mobile telephone number, or other information needed to contact you online and over the phone. We use your e-mail address and other contact information you provide us with to confirm your order and to communicate with you in case of an order problem, so one cannot register without an e-mail address and a mobile telephone number. We communicate part of your contact information (name, surname, order delivery address and phone number) with the kitchen from which you have placed an order. We also use this information to facilitate and improve your use of the website, to communicate with you, for internal purposes and to comply with any requirements of law. This information may be disclosed to our staff and to third parties involved in the delivery of your order or the analysis and support of your use of the website. We do not sell and will not divulge your personal contact information to third parties other than as specified in this Privacy Policy without your permission unless we are legally entitled or obliged to do so (for example, if required to do so by Court order or for the purposes of prevention of fraud or other crime).

Credit Cards and Payment Information

 

When you place an order through the App, you are required to select a method of payment. Home Oven is not interested in your debit/credit card information nor do store any of your debit/credit information, since orders could be paid at the door directly to the Kitchens through methods of payment such as cash. Online debit/ credit card payment is also an option, and for some kitchens it can be the only method of payment. For transactions with online debit/credit cards, we transmit your entire card information to the appropriate debit/credit card company in an encrypted format with globally accepted rules and applications during order processing.

Order Placement Information

 

Personal information required during the order process includes name, address, phone number, email address and other similar information used to identify you and complete an order. Personal information collected at our site will be shared with the kitchen when processing your order. Your personal information will be used to notify you of your order status. Personal information will not be shared with any of our business partners or affiliates without your permission. It is treated as confidential, and will not be disclosed to outside parties, unless compelled by applicable legislation.

Marketing

 

We don't sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising. If you do not want to receive marketing communications from us via e-mail or participate in our ad-customization programs, simply communicate your preference to us via e-mail.

How Is Personally Identifiable Information Disclosed?

 

We may disclose Personally Identifiable Information:

To our third party service providers who provide services such as website hosting, data analysis, payment processing, order fulfillment, infrastructure provision, IT services, customer service, e-mail delivery services, credit card processing and other similar services to enable them to provide services.

As required to fulfill your purchase (e.g., to our kitchen partners to enable them to fulfill your order).

Cookies

 

When you visit our site, our server sends your computer a "cookie." This cookie is a small packet of information that identifies you as a user of our system. Cookies save you time by retaining your contact information. You have the ability to accept or decline cookies by modifying the settings in your browser. Please bear in mind however, that you may not be able to use all the features of our site if cookies are disabled.

Protection of Your Personal Information

 

Our website has secure pages to collect user information and most critical data is stored in encrypted form. We use various technical and management practices to help protect the confidentiality, security and integrity of data stored on our system. Our servers use Secure Sockets Layer (SSL) and encryption technology that works with Microsoft Internet Explorer, Firefox, Safari and Chrome.

We use reasonable organizational, technical and administrative measures to protect Personally Identifiable Information under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. Please do not send us sensitive information through email. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), you must immediately notify us of the problem by contacting us in accordance with the "Contacting Us" section below.

Third parties

 

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including without limitation any of our affiliates and any third party operating any site to which this site contains a link. The inclusion of a link on the site does not imply endorsement of the linked site by us or by our affiliates.

It is very important to us that we provide you with the highest level of service. In order to help us do this, from time to time we may send you details of products, services, discounts, promotions and campaigns, which we think, may be of interest to you. We may send you marketing communications with your consent. If at any time you do not wish to receive these details and wish to unsubscribe from marketing communications, contact us via e-mail.
